On Thursday, February 17th, Judge Gettleman sentenced me to 30 days in jail. I was granted a chance to fight this sentencing by presenting the case to the 7th U.S. Circuit Court of Appeals. My lawyers have requested that I not comment until the legal proceedings are final. However, I will be live on the radio on Tuesday, February 23rd and a new recorded show will broadcast on Wednesday.

Syndicated Radio Host Remains Free Despite Ire of Judge

CHICAGO- Embattled radio host, #1 New York Times best-selling author, consumer advocate, and longtime TV personality Kevin Trudeau’s fate lays in the hands of an Appellate Court which hears arguments on Feb. 23 whether he should serve 30 days in county jail for criminal contempt of court. The contempt charge stemmed from a recent broadcast of Trudeau’s nationally syndicated radio show in which he urged listeners to email the judge presiding over his federal court case—and hundreds of emails allegedly clogged the judge’s account within hours. On the February 10 broadcast of “The Kevin Trudeau Show” on WJJG/Chicago, Trudeau said “If you’re listening, and you like what I’m doing, and you want me to continue, you like my show, you think my ads are not misleading and deceptive…you think what I’m doing is good, you should write a letter to the judge [Robert Gettleman] and the Federal Trade Commission.” Over the next 24 hours, Judge Gettleman said his email box was flooded with so many emails that his computer and Blackberry succumbed to the deluge and his inbox was temporarily shut down.

Judge Gettleman has been presiding over the FTC civil case against Trudeau stemming from an infomercial for his book The Weight Loss Cure ‘They’ Don’t Want You to Know About in which Trudeau said the weight loss protocol was “easy.” The FTC objected to his use of the term and Judge Gettleman agreed, finding Trudeau in contempt of court in 2007. He has since been fined $37 million dollars in connection with that contempt ruling, though the fine has been reversed in an appellate victory for Trudeau. In March, Gettleman is set to impose yet another fine.

On February 11, one day after the broadcast and alleged email barrage, Judge Gettleman ordered Trudeau to appear before him, berated him, and found him in criminal contempt of court for having “interfered with the direct process of the court.”

Trudeau is undaunted by this latest dustup with the federal government. Though his legal run-ins with the government are well documented over the past two decades, he says he’s “proud of being found in violation” of laws “designed to suppress freedom of speech and the free-flow of information.” While he asked listeners not to correspond any further with Judge Gettleman via his publicly-published email address, Trudeau did note that “not many radio hosts in the world could ask listeners to act and get such a response.”

“Think about it,” KT Radio Network General Manager Matt DuBiel said. “Who in America could elicit such a response? Rush [Limbaugh]? [Howard] Stern? Maybe a handful of broadcasters? It’s obvious KT’s listeners and fans number in the millions, and the government is hell-bent on silencing people with such considerable influence. We’ve been told no one threatened this judge, nor were they asked to. KT merely asked that supporters of him, his show, and his message let their voices be heard. Apparently the men in the ivory towers don’t want to hear from everyday, average Americans while they rule with impunity behind their lifetime appointments. KT won’t stop fighting the corruption that pervades the government and its henchmen in the FTC, and apparently many people applaud his efforts.”

Trudeau Granted Temporary Relief from Jail

Infomercial pitchman Kevin Trudeau came to court Thursday dressed casually in bluejeans, a sign he expected to be jailed for ticking off a judge when supporters bombarded the judge with hundreds of e-mails.

But he won at least a temporary reprieve from jail Thursday when the 7th U.S. Circuit Court of Appeals agreed to let him remain free while it quickly decides his appeal of his contempt citation and 30-day sentence.

U.S. District Judge Robert Gettleman, miffed that he had even received an e-mail Thursday morning from a Trudeau supporter, instructed Trudeau to refrain from encouraging any further e-mails to the court.

Gettleman, overseeing a lawsuit against Trudeau, found him in contempt last week. He called the barrage a deliberate attempt to “harass, intimidate and influence” him.

After Gettleman imposed the 30-day sentence Wednesday, Trudeau’s lawyers filed an emergency motion asking he remain free until his appeal was decided. On Thursday, less than half an hour before Trudeau was scheduled to surrender to federal marshals, the appeals court granted the motion. Oral arguments will be held Tuesday.

Trudeau’s lawyer, Kimball Anderson, said his client, who had looked dapper in recent appearances with a suit and fedora, dressed casually Thursday because he expected to be taken into custody.

Trudeau, asked by reporters as he left the courthouse Thursday about his casual attire, replied with a smile, “That’s a GQ question. I can’t answer that.”

Statement by Kimball Anderson, Attorney for Kevin Trudeau

CHICAGO, February 17, 2010 — Attorney Kimball Anderson stated, “We believe today’s ruling by the District Court ordering the incarceration of Kevin Trudeau for criminal contempt exceeds the permissible bounds of the district court’s authority. Mr. Trudeau has committed no crime; he has violated no statute; and he has violated no court order. Mr. Trudeau believes that he was simply exercising his First Amendment Rights and was permissibly encouraging others to do the same on his radio show.

Anderson said, “We encourage the public to read the emails that various citizens sent to the District Court. The emails are not threatening or abusive. Instead, they overwhelmingly support the exercise of Mr. Trudeau’s 1st Amendment rights.”

“On behalf of Mr. Trudeau, we are seeking an immediate hearing before the 7th Circuit Court of Appeals and to stay Mr. Trudeau’s sentence that the District Court ordered to commence tomorrow, at 2:15 pm.” Anderson concluded, “We expect that his rights will be vindicated shortly.”

Food Labels May Mislead You

A very common question I get….

Dear Kevin,

How come you don’t talk about calories, fats, protein, or carbohydrates?

Everyone talks about calories, fats, protein, carbohydrates, sodium, and things of this nature. The fact of the matter is they are important, but not very important when compared to the chemicals and poisons put into the food. If you get your food here like me, you don’t have anything to worry about.

What is more important than calories or fats and carbohydrates is the chemical fertilizers used in the food, the pesticides used in the food, the fact that the food is picked early and then gassed, the fact that the food is genetically modified and manufactured in an unnatural way, the processing methods that are used, the irradiation that was used, the actual thousands of chemicals that are put in processed food to make it taste better and give it certain textures, preserve it, or specifically designed to get you chemically and physically addicted to the food, increase your appetite and make you fat.

This is what is more important than the amount of calories, or the amount of fat, or the amount of carbohydrates. That’s what everyone is missing.

Judge Finds Me In Criminal Contempt of Court!

I get a lot of emails about Candida and what it’s all about. We all have Candida to some degree or other. The question is whether it is an overgrowth situation.
