Important Victories Won Over Monsanto, Other GMO Corporations

With all the bad news about Monsanto and other corporations who create and promote GMOs, here’s a couple of good news items from the last couple of years to relieve some doom and gloom. Hopefully, these victories against GMO companies, one by an individual farmer in Canada, the other by a large rice collective in the USA, will inspire others to hold their ground.

Normally, bully Monsanto sues small independent farmers, forcing them to pay fees for GMO plants that grew from various sources of GMO contamination, not by the farmer’s choice. But the expense and mental strain of lengthy legal procedures against a wealthy corporation with soulless attorneys is too much to bear. So many settle rather than go bankrupt with Monsanto seizing the farm.

A feisty Canadian commercial canola farmer, Percy Schmeiser, started his fight against Monsanto’s intimidation tactics in 1998. This is not a promotion of canola, but the story of a farmer who has used, saved, and developed his own seeds on his own land for over 40 years, and his David versus Goliath struggle.

After discovering his crops had been contaminated with GMO seeds from neighboring farms and passing Monsanto trucks, he was sued by Monsanto for patent infringement. Monsanto has been in the business of intimidating farmers with a similar fate by suing them for patent infringement after their fields were contaminated from GMO farms.

This intimidation and harassment has either bankrupted farmers or forced them into signing onto Monsanto’s seed plan. Big bully companies use lawsuits to financially destroy small businesses even if there is no actual violation. Schmeiser and his wife, both approaching 70, decided to fight it out on principle.

Patent law says there is no violation if a patented product is not used or stolen. After some back and forth court battles and appeals over ten years, Percy won. Monsanto agreed to settle out of court by paying for cleaning up Percy’s farm and not issue a gag order (customary with settlements), which enables Percy to continue touring with his message of resisting GMO and corporate intimidation. The agreement also left Monsanto liable for any recontamination of Percy’s farm.

Sometimes when a big guy goes after a trouble maker, the trouble maker gets it big. In April 2011, Riceland Foods won a major case against Bayer Crop Science in the Arkansas State Court System. The case involved contamination from an experimental, unapproved GM rice, Liberty Link. Its function is withstanding unlimited use of Bayer’s herbicide Liberty.

President’s Illegal Uncle Giggles In Court

A giggling Onyango Obama — the president’s illegal alien half uncle — made a brief appearance in Framingham District Court today on charges he was drunk when he nearly struck an unmarked police cruiser last month.

Obama, 67, was visibly amused at the media spectacle, stifling laughter several times before his 30-second court appearance where a judge set a Nov. 17 pre-trial conference.

Obama did not acknowledge a Herald reporter’s question upon arrival at Framingham District Court and neither he nor his lawyer made any comment on his way out where they were followed to the parking lot by a horde of media.

His attorney, P. Scott Bratton, did, however, tell the Herald that Obama, who has been living illegally in the United States for nearly 20 years, has returned to work at Conti Liquors in Framingham.

“He has. He’s doing well,” Bratton said.

Obama was accompanied in court today by two attorneys and an unidentified male supporter. He and his friend giggled in the front row of the court at the media assembled for the hearing. The courtroom was packed, but mostly with other defendants hauled in for the usual round of arraignments at the county court located in suburban Boston.

Onyango, who had a valid driver’s license and Social Security card when he was arrested last month, was in the U.S. illegally having already faced a 1992 deportation order. Immigration officials have ordered him to “check in” with them.

When he was arrested by Framingham police on suspicion of drunken driving Aug. 24, he suggested his first call should be to the White House. A spokesman for the president told the Herald that call was never made. He actually called his boss at Conti’s Liquors.

Middlesex District Attorney Gerard T. Leone has also vowed to prosecute Obama to the fullest extent possible on the OUI charge.

Man Robs Bank For One Dollar So He Can Get Health Care In Jail

Often, crimes are borne of desperation. However, most robberies aren’t motivated by a desperate need for health care.

James Richard Verone, of Georgia, attempted to steal one dollar from a bank so that he would be arrested, taken to jail and — most importantly — provided with health care, the Gaston Gazette reported.

Verone worked for Coca-Cola for 17 years, but lost that job three years ago. Now 59 years old, Verone can’t handle the physical demands of the part-time jobs, like working in a convenience store, that he has successfully been hired for. Hence, he has no health care.

“The pain was beyond the tolerance that I could accept,” he told the Gazette. “I kind of hit a brick wall with everything.”

He had no criminal record prior to the planned robbery June 9, either. On that day, he walked into a bank, handed the teller a note demanding a dollar, then sat and waited calmly for the police to arrive and arrest him.

Verone has problems with his back, an aching left foot, arthritic hands, carpal tunnel syndrome, and an undiagnosed protrusion on his chest. He’s hoping to be examined and treated, and serve enough time that when he is released, he will be able to collect Social Security benefits. Verone is banking on a lengthy stay: Before he robbed the bank, he sold his furniture and moved out of his apartment.

Verone plans to represent himself in court during his hearing for his crime, larceny from a person (because the amount he demanded was so small, he was not charged with bank robbery). If he is released, or if his sentence is unsatisfactorily short, Verone said he would again turn to crime.

“I knew that a felony would not hurt me. I cannot work anymore,” he said. “That felony is going to hurt my reputation.”

Drug Makers Can’t Be Sued Over Vaccine Side Effects

The Supreme Court ruled Tuesday that a federal law bars lawsuits against drug makers over serious side effects from childhood vaccines.

By a 6-2 vote, the court ruled against the parents of a child who sued the drug maker Wyeth in Pennsylvania state court for the health problems they say their daughter, now 19, suffered from a vaccine she received in infancy.

Justice Antonin Scalia, writing for the court, said Congress set up a special vaccine court to handle such claims as a way to provide compensation to injured children without driving drug manufacturers from the vaccine market. The idea, he said, was to create a no-fault system that spares the drug companies the costs of defending against parents’ lawsuits.

Justices Ruth Bader Ginsburg and Sonia Sotomayor dissented. Nothing in the 1986 law “remotely suggests that Congress intended such a result,” Sotomayor wrote, taking issue with Scalia.

Scalia’s opinion was a stinging defeat for parents who found their award from the vaccine court insufficient or failed to collect at all.

Such was the case for Robalee and Russell Bruesewitz of Pittsburgh, who filed their lawsuit after the vaccine court rejected their claims for compensation. According to the lawsuit, their daughter, Hannah, was a healthy infant until she received the diphtheria, tetanus and pertussis vaccine in April 1992. The vaccine was made by Wyeth, now owned by Pfizer, Inc.

Within hours of getting the DPT shot, the third in a series of five, the baby suffered a series of debilitating seizures. Hannah continues to suffer from residual seizure disorder, the suit says.

Scalia said that when a vaccine is properly prepared and is accompanied by proper directions and warnings, lawsuits over its side effects are not allowed under the 1986 law.

“Vaccine manufacturers fund from their sales an informal, efficient compensation program for vaccine injuries,” Scalia said. “In exchange they avoid costly tort litigation and the occasional disproportionate jury verdict.”

The American Academy of Pediatrics, representing more than 60,000 doctors, praised the decision. “Childhood vaccines are among the greatest medical breakthroughs of the last century,” said Dr. Marion Burton, the group’s president. “Today’s Supreme Court decision protects children by strengthening our national immunization system and ensuring that vaccines will continue to prevent the spread of infectious diseases in this country.”

The vaccine court has paid out more than $1.9 billion to more than 2,500 people who claimed a connection between a vaccine and serious health problems.

The drug companies worried that they would face a flood of lawsuits over the side effects of vaccines in the event of an unfavorable Supreme Court decision. They were especially concerned about claims from families of autistic children who say the vaccines, or mercury-based thimerosal that once was used to preserve them, are linked to autism. Numerous studies have addressed vaccines and autism and found no link, including with the preservative.

Pfizer applauded the decision. “We have great sympathy for the Bruesewitzes,” Pfizer Executive Vice President and General Counsel Amy Schulman said, “We recognize, however, that the Vaccine Act provides for full consideration of the liability issues through the National Vaccine Injury Compensation Program. Here the Vaccine Court concluded that the petitioners failed to prove their child’s condition was caused by vaccination.”

David Frederick, who represented the Bruesewitz family at the Supreme Court, said, “I’m disappointed for the families of victims of defectively designed vaccines, who now have no remedy at law for their injuries.”

Justice Elena Kagan took no part in the case because she worked on it while serving in the Justice Department.

The case is Bruesewitz v. Wyeth, 09-152.
