Major Drug Company Pays $44 Million to Settle Kickback Claims

Swiss biotech giant EMD Serono Inc. agreed to pay $44.3 million last month to settle federal charges of kickbacks that resulted in the submission of false claims to Medicaid and Medicare for its multiple sclerosis drug Rebif.

Serono was accused by the U.S. federal government and a number of states of violating the False Claims Act, a federal law aimed at companies that defraud governmental programs. Serono, government attorneys said, essentially paid doctors to prescribe Rebif to patients suffering from multiple sclerosis.

“Health care decisions must be based solely upon what is best for the individual patient and not on which pharmaceutical company is paying the doctor the biggest kickback,” Rod J. Rosenstein, U.S. attorney for the District of Maryland, said in a statement.

“All consumers have the right to know that their health care provider’s judgment about medications they should take has not been undermined by kickbacks from pharmaceutical manufacturers,” Rosenstein added.

Rebif was launched in 2002, and from then until 2009, the Justice Department alleged, Serono paid medical professionals to promote and prescribe the drug to treat relapsing forms of multiple sclerosis.

Serono, the Justice Department asserted, paid health care professionals for speaking engagements and attending training, advisory, consultant and marketing meetings — many of which were held at lavish resorts and upscale urban locations — designed to promote Rebif.

All of these actions, government attorneys said, resulted in false claims for Rebif to federal health care programs such as Medicare and Medicaid — claims that were tainted by kickbacks.

“It’s imperative that medical determinations are guided by a patient’s needs, not tainted by illegal incentives or fraud,” Tony West, assistant attorney general of the civil division, said in a statement. “We are committed to ensuring that the chronically ill and other vulnerable members in our communities who rely on Medicare and Medicaid programs receive the best possible care.”

In a press release issued by the company, Serono stressed the fact the settlement did not require the company to admit any wrongdoing.

“It is important to note that the settlement contains no claims that unnecessary prescriptions for Rebif were written, no allegations of patient harm and no admission of fault by the company,” Thomas G. Gunning, senior vice president and general counsel for EMD Serono Inc.. said in a statement. “EMD Serono is committed to operating its business with the highest legal, compliance and ethical standards.”

The federal government will receive $34.6 million of the $44.3 million settlement, with the states sharing the remaining $9.7 million. State payments were based on how much was spent on Rebif in each state. The state of New York, for example, will receive $2.5 million from the settlement, while Washington will receive $338,000.

“Those who compromise the integrity of the markets for profit at the expense of taxpayers will be forced to pay,” New York Attorney General Eric T. Schneiderman said in a statement. “Taxpayers and, in this case, patients must have absolute confidence that they are receiving health care on the merits [of their needs] and that taxpayers are getting the best deal possible.”

The Serono settlement resulted from an investigation by the U.S. Attorney’s office for the District of Maryland, with assistance from the U.S. Department of Justice and other federal agencies. Since January 2009, the Justice Department has used the False Claims Act to recover more than $7.3 billion, including approximately $5.7 billion in cases involving federal health care program fraud.

This isn’t Serono’s first brush with U.S. law. In 2005, Serono paid $704 million to the federal government and the states to settle criminal charges and civil allegations of illegal activity to promote, market and sell its AIDS drug, Serostim, between 1996 and 2004. Under the settlement, Serono paid a $136.9 million criminal fine, while its affiliate companies coughed up $567 million to settle civil accusations.

Johnson & Johnson Settles Bribery Case With Feds

Pharmaceutical giant Johnson & Johnson has agreed to pay $70 million to settle civil and criminal charges of bribing doctors in Europe and paying kickbacks to the Iraqi government to illegally obtain business.

The Securities and Exchange Commission said Friday that the company settled the charges with the agency and the Justice Department without admitting or denying guilt.

The government accused J&J subsidiaries of providing money and travel gifts to doctors in Greece, Poland and Romania in exchange for their prescribing J&J products to patients. The SEC says J&J agents used fake contracts and sham companies to deliver the bribes. The SEC says the bribes began at least 13 years ago.

J&J subsidiaries also allegedly paid kickbacks to the Iraqi government to obtain contracts under the United Nations Oil for Food Program.

J&J said in a statement that it alerted the government to the medical device kickbacks in 2007. The company identified similar violations across multiple businesses over the next three years, it said.

“We went to the government to report improper payments and have taken full responsibility for these actions,” said William Weldon, Chairman and CEO of J&J. “I know that these actions are not representative of Johnson & Johnson employees around the world who do what is honest and right every day.”

A spokeswoman for the company added that none of the employees cited in the charges are currently employed by J&J. The company said it expects to reach a settlement with regulators in the United Kingdom in the next several days.

The charges against J&J were brought under the Foreign Corrupt Practices Act, which bars publicly traded companies from bribing officials in other countries to get or retain business. In the past five years, the Justice Department has investigated several companies that sell medical devices in foreign countries for violating the law.

J&J’s household reputation has been battered in the past year by a string of recalls, including over-the-counter medicines — such as Children’s Tylenol and Benadryl — contact lenses and orthopedic hips.

Last month federal health regulators took legal control of the plant where millions of bottles of defective medication were produced.

The New Brunswick, N.J.-based health care company sells everything from Band-Aids to biotech drugs. J&J shares rose 7 cents to $59.55 Friday

TSA Screening Supervisor Admits to Stealing from Passengers

A Transportation Security Administration (TSA) airport screening supervisor at Newark Liberty International Airport has admitted to taking kickbacks from a subordinate who stole cash from airline passengers.

Michael Arato, 41, admitted in federal court he was involved in stealing from passengers going through security screening at the New Jersey airport’s Terminal B. He was arrested for the crimes in October.

Prosecutors say Arato and his screener co-worker stole $10,000 to $30,000 in cash from passengers’ carry-on bags over a period of 13 months. As the boss, Arato made his subordinate give him a kickback on anything the man stole.

The two screeners reportedly targeted their victims, who were mostly non English-speaking women flying home to India.

The men were blatant in their thievery, even splitting up the cash in front of airport security cameras, according to authorities.

The other screener, who has not been named, cooperated with the investigation.

Arato faces a maximum of 15 years in prison at his sentencing on May 24.

Senate Removes Federal Judge For Kickbacks and Lying

The U.S. Senate found Federal Judge G. Thomas Porteous of Louisiana guilty on four articles of impeachment on Wednesday, which will remove him from the federal bench.

He had been accused of accepting kick-backs and lying to the Senate and FBI.

The vote makes Porteous, 63, only the eighth federal judge in the nation’s history to be impeached and convicted.

Porteous is also “forever disqualified to hold and enjoy any office of honor, trust or profit under the United States,” Sen. Daniel Inouye said during Wednesday’s Senate hearing.

The Senate adopted the motion barring Porteous from holding a future federal office by a vote of 94 to 2.

In March, the House of Representatives voted unanimously to impeach Porteous on corruption charges.

“Our investigation found that Judge Porteous participated in a pattern of corrupt conduct for years,” U.S. Rep. Adam Schiff, D-California, chairman of the House Judiciary Committee Task Force on Judicial Impeachment.

In a statement at the time, Porteous’ lawyer, Richard W. Westling, said the Justice Department had decided not to prosecute because it did not have credible evidence.

“Unfortunately, the House has decided to disregard the Justice Department’s decision and to move forward with impeachment,” he said. “As a result, we will now turn to the Senate to seek a full and fair hearing of all of the evidence.”

Porteous, who turns 64 this year, was appointed to the federal bench in 1994. He has not worked as a judge since he was suspended with pay in the fall of 2008, Westling said.

The most recent previous impeachment of a federal judge by the House was last year.

Judge Samuel B. Kent of the U.S. District Court for the Southern District of Texas resigned after being impeached on charges of sexual assault, obstructing and impeding an official proceeding and making false and misleading statements, according to the website of the Federal Judicial Center.

Before then, Judge Walter L. Nixon of U.S. District Court for the Southern District of Mississippi was impeached in 1989 on charges of perjury before a federal grand jury. The Senate convicted him and removed him from office that year.
