Once again, another government bureaucrat, this time the boss of the all-power National Security Agency, has taken us for idiots.

General Keith Alexander, who insists hackers can take down power grids not hooked up to the internet, recently told Congress the NSA does not have the ability to look at your email.

And there is a bridge in Brooklyn we’d like to sell you.

Here’s what Alexander told Congress:

“NSA does not have the ability to do that (spy on citizen emails) in the United States….We don’t have the technical insights in the United States. In other words, you have to have something to intercept, or some way of doing that either by going to a service provider with a warrant or you have to be collecting in that area. We’re not authorized to do that, nor do we have the equipment in the United States to collect that kind of information.”

I guess Mr. Alexander did not see the report issued by the European Parliament back in 2001 about the NSA’s Echelon. Not only can they intercept and read your email, but also your telephone calls, fax, and other data.

Then there was the AT&T employee Mark Klein. He revealed a few years ago that his company was in cahoots with the NSA and they were vacuuming up enormous amounts of data from the internet.

The spring air in the small, sand-dusted town has a soft haze to it, and clumps of green-gray sagebrush rustle in the breeze. Bluffdale sits in a bowl-shaped valley in the shadow of Utah’s Wasatch Range to the east and the Oquirrh Mountains to the west. It’s the heart of Mormon country, where religious pioneers first arrived more than 160 years ago. They came to escape the rest of the world, to understand the mysterious words sent down from their god as revealed on buried golden plates, and to practice what has become known as “the principle,” marriage to multiple wives.

Today Bluffdale is home to one of the nation’s largest sects of polygamists, the Apostolic United Brethren, with upwards of 9,000 members. The brethren’s complex includes a chapel, a school, a sports field, and an archive. Membership has doubled since 1978—and the number of plural marriages has tripled—so the sect has recently been looking for ways to purchase more land and expand throughout the town.

But new pioneers have quietly begun moving into the area, secretive outsiders who say little and keep to themselves. Like the pious polygamists, they are focused on deciphering cryptic messages that only they have the power to understand. Just off Beef Hollow Road, less than a mile from brethren headquarters, thousands of hard-hatted construction workers in sweat-soaked T-shirts are laying the groundwork for the newcomers’ own temple and archive, a massive complex so large that it necessitated expanding the town’s boundaries. Once built, it will be more than five times the size of the US Capitol.

Rather than Bibles, prophets, and worshippers, this temple will be filled with servers, computer intelligence experts, and armed guards. And instead of listening for words flowing down from heaven, these newcomers will be secretly capturing, storing, and analyzing vast quantities of words and images hurtling through the world’s telecommunications networks. In the little town of Bluffdale, Big Love and Big Brother have become uneasy neighbors.

NSA Whistle-Blower: Obama “Worse Than Bush”

Thomas Drake, the whistle-blower whom the Obama administration tried and failed to prosecute for leaking information about waste, fraud and abuse at the National Security Agency, now works at an Apple store in Maryland. In an interview with Salon, Drake laughed about the time he confronted Attorney General Eric Holder at his store while Holder perused the gadgetry on display with his security detail around him. When Drake started asking Holder questions about his case, America’s chief law enforcement officer turned and fled the store.

But the humor drained away quickly from Drake’s thin and tired face as he recounted his ordeal since 2010 when federal prosecutors charged him with violating the Espionage Act for retaining classified information they believed he would pass on to then Baltimore Sun reporter Siobhan Gorman. While Drake never disclosed classified information, he did pass on unclassified information to Gorman revealing that the NSA had wasted billions of taxpayers’ dollars on Trailblazer, a contractor-heavy intelligence software program that failed to find terrorist threats in the tsunami of digital data the agency was sucking up globally — and sometimes unconstitutionally. While Trailblazer burned through cash, in the process enriching many NSA employees turned contractors, Drake found that another software program named ThinThread had already met the core requirements of a federal acquisition regulation that governed the proposed system at a sliver of the cost, all while protecting American civil liberties at the code level. The NSA leadership, however, had already bet their careers on Trailblazer. So Drake blew the whistle, first to Congress, then to the Department of Defense Inspector General’s Office, and finally, and fatefully, to Gorman.

Last June, the government’s case collapsed. On the eve of trial, all 10 counts were dropped. In a Kafkaesque turn of events, Drake actually helped the government find a misdemeanor to charge him with — exceeding authorized use of an NSA computer — so federal prosecutors could save face. Once facing 35 years behind bars, Drake pled guilty to the misdemeanor charge and was sentenced to one year of probation and 240 hours of community service, what he sardonically calls “his penance.”

No Checks or Balances in Warrantless Wiretapping Despite Holder’s Assurances

Attorney General Eric Holder gave a much publicized speech at Northwestern law school on Monday, in which he attempted to explain the Obama administration’s constitutional authority for killing U.S. citizens abroad without judicial oversight. Holder in part claimed that there is a difference between “due process” and “judicial process”, the latter of which—according to him—is not guaranteed under the Constitution. The speech was predictably and widely criticized in legal circles on Fifth Amendment grounds (see here, here, here, here, and here),but an overlooked section of his speech should also give constitutional experts pause: Holder’s stance on the FISA Amendments Act (FAA) and warrantless wiretapping.

Holder spent a portion of his speech arguing that legal tools used to fight terrorism (excluding the killing of al-Awlaki and other American citizens overseas) are rightly subject to “check and balances” and “a comprehensive regime of oversight by all three branches of government.” He curiously used section 2702 of the FAA as his prime example, a law he says “protect[s] the privacy and civil rights of innocent individuals.”

As EFF readers will remember, the FAA is the statute Congress passed giving immunity to telecom companies despite their participation in the NSA’s massive warrantless wiretapping program, which the New York Times first exposed in 2005. EFF and a host of other civil liberties groups have been involved in litigation challenging the constitutionality of warrantless wiretapping for years.

Former member of the Obama administration’s Office of Legal Counsel Marty Lederman explains section 702 of the FAA “permits the NSA to intercept phone calls and e-mails between the U.S. and a foreign location, without making any showing to a court and without judicial oversight, whether or not the communication has anything to do with al Qaeda—indeed, even if there is no evidence that the communication has anything to do with terrorism, or any threat to national security.” All told, the “collection systems at the National Security Agency intercept and store 1.7 billion e-mails, phone calls and other types of communications” every day, according to the Washington Post.

During the Senate’s major hearing on cybersecurity last week, Senator John McCain, a Republican from Arizona, announced that the Republicans in the Senate would introduce a bill to compete with S. 2105, also known as the Cybersecurity Act of 2012.

McCain seeks to give the NSA and the military previously unimaginable powers over civilian networks, even further expanding the ludicrous power over American citizens given to the military under the National Defense Authorization Act for Fiscal Year 2012 (NDAA).

This is similar to the conclusions drawn by a study conducted by the Massachusetts Institute of Technology (MIT), which unsurprisingly had a long list of corporate “advisers” who would directly benefit from such a centralization.

Although, even the legislation as it is currently being considered follows the study’s recommendations by putting the power in the hands of DHS. McCain would apparently rather see that power in the military’s hands.

The Cybersecurity Act of 2012 is currently being supported by the chairmen of not only the Senate’s Homeland Security committee but also the chairs of the commerce and intelligence committees as well.

The current bill is cosponsored by Senators Joseph Lieberman, a Connecticut Independent, Jay Rockefeller, a West Virginia Democrat and Dianne Feinstein, a Democrat from California.

McCain spoke out against rushing the debate on this legislation and instead called for widening the role of the National Security Agency (NSA) in cybersecurity matters domestically.

On the February 16 hearing of the Senate Homeland Security and Governmental Affairs Committee McCain said that the fact that similar legislation has been introduced in the past by Lieberman and Senator Susan Collins, a Maine Republican, in the past does not mean that this new bill should be rushed to a vote.

“To suggest that this bill should move directly to the Senate floor because it has ‘been around’ since 2009 is outrageous,” McCain said.

“First, the bill was introduced two days ago. Secondly, where do Senate Rules state that a bill’s progress in a previous congress can supplant the necessary work on that bill in the present one?”

Google Caught Violating Browser Privacy Settings to Track Users

Following the revelation that Google had been tracking the surfing habits of iPhone users via a code that disables the Safari browser’s privacy settings, Microsoft has now discovered that Google is using similar methods to bypass privacy protections and spy on the browsing habits of Internet Explorer users.

“When the IE team heard that Google had bypassed user privacy settings on Safari, we asked ourselves a simple question: is Google circumventing the privacy preferences of Internet Explorer users too? We’ve discovered the answer is yes: Google is employing similar methods to get around the default privacy protections in IE and track IE users with cookies,” reports Microsoft on their IEblog.

Last week it was revealed that Google had circumvented Apple’s efforts to block third party cookies by default, allowing Google to track which ads Safari users clicked on.

The Internet giant, whose motto is “don’t be evil,” has now been caught using a similar process to disregard cookie preferences of Internet Explorer users, allowing targeted ads to be served based on browsing history.

“Google is trying to do is figure out things based on what you have looked at, figure out ways to serve you more relevant ads,” explains Henry Blodget. “Google intentionally circumvented some privacy protections that Apple put in place, now Microsoft is saying ‘hey wait a minute, they did the same thing to us.’”

While Google’s actions are not illegal, they will only serve to underscore the fact that the company has a flagrant disregard for privacy, which is no surprise given Google CEO Eric Schmidt’s creepy 2009 warning, when he stated, “If you have something that you don’t want anyone to know, maybe you shouldn’t be doing it in the first place.”

Indeed, as we have documented on numerous occasions, Google’s actions are completely consistent with the charge that the company is in cahoots with the National Security Agency, America’s foremost spying operation.

Last year the Washington Post reported that Google and the NSA had formed an “alliance…to allow the two organizations to share critical information.”

You see, those remote control bombers-in-a-cave who baffled America’s defenses and brought down 3 towers in NYC and smashed through the recently reinforced facade of the accounting division of the Pentagon that was trying to find Rumsfeld’s missing trillions he announced the night before…yes, those guys, who we can’t seem to find or kill off after 10 years of war in Afghanistan and later Iraq and now all of frikking NATO attacking the whole damned region can’t find by the most sophisticated military in the history of mankind…

…We are being protected from THEM!…clearly they’re VERY CLEVER!..and WE NEED PROTECTION!!

Let Me Count The Ways…We’re Being Eyeballed, Indexed and Monitored to Oblivion:

1. Credit/Debit and RFID use: Every transaction, ID and passport use is monitored and tracked. Your buying habits are sold to corporations and your personal information given to the US Department of Justice in some form. Rely on it. Your privacy rights have vanished. RFIDs are soon to be in all forms of ID, used for medical records, are in your food and products for “tracking” and soon to be under everyone’s skin. Beware. That one’s a biggie.

2. Phone and Internet use. Forget it, they know everything. The NSA is in bed with the servers and providers so kiss internet and cellular privacy goodbye, subjects. Don’t believe that? Go googling. Now. Before it disappears.

3. GPS and Drones. “Thanks for the self-bought tracking device, Philbert.” They can pinpoint anyone. GPS, phone, lowjack, OnStar…those just help. Watch for the policing drones and other technologies to follow soon. You are not alone…anywhere!

4. Smart Meters. They read all your home’s devices, track your activities and give off more radiation than a cell phone tower! Nice, eh? Clever bastards.

5. Chemtrails and EMFs. By now we’ve all inhaled, eaten and drunk enough barium, and aluminum, to be tracked from space. EMFs from cell and GWEN towers screw with your nervous system more than ever and influence your thoughts, as does your TV. Happy yet?

6. The Obvious CCTV cameras…and the Not Obvious ones. In the UK they’re IN the busses as well as outside the busses…never mind in trees in the countryside! Yes, it’s gone that far, and will in the US soon too. Smile. There’s 8 to 12 every intersection…don’t you wonder the hell why?

7. Scans and More Scans. Old news. Airport, transport, mobile and soon to be everywhere: Metal detectors, feel-downs and ups, and the latest: backscatter machines that unzip your DNA! Getting the picture?

8. Fingerprints and Iris scanners. Notice how many want fingerprints now? And iris scanners are already in place in many airports, in fact I’ve heard this is the first thing the NYPD is doing to anyone arrested at OWS. Beware.

9. Facial recognition technology. “Yay! We’ll catch all those buggers now! But why am I suspect?” Coming “officially” in January (which means they’ve been experimenting and using it for some time already…..) and..

10. Precrime detection! Yes, movies DO come to life! They’re working fervently on detecting your MOOD and will summarily assume at will you have BAD INTENTIONS with this one! Beware being pissed or on a bummer in public…YOU could be a terrorist!!

11. Intention To Trespass Outside the Country? Yup. Here’s a brand new doozy. “You gonna circumvent your domesticating home country’s laws on substance regulation, you wild and crazy thing? Damn you…you get back in the house right now!”

Comforted yet? I hope so. We are getting so safe we should sleep peacefully for 12 hours a night now. In fact, most Americans are sound asleep fulltime by now, so overwhelmed with safekeeping.

If not, “the intrustions will continue until morale improves..”
Sweet dreams………..or wake the hell up

…time’s running out. Sittling still means you’re stupified and controlled, if you didn’t know by now. Surprise!

The U.S. government, with assistance from major telecommunications carriers including AT&T, has engaged in a massive program of illegal dragnet surveillance of domestic communications and communications records of millions of ordinary Americans since at least 2001.

News reports in December 2005 first revealed that the National Security Agency (NSA) has been intercepting Americans’ phone calls and Internet communications. Those news reports, plus a USA Today story in May 2006 and the statements of several members of Congress, revealed that the NSA is also receiving wholesale copies of their telephone and other communications records. All of these surveillance activities are in violation of the privacy safeguards established by Congress and the U.S. Constitution.

The evidence also shows that the government did not act alone. EFF has obtained whistleblower evidence [PDF] from former AT&T technician Mark Klein showing that AT&T is cooperating with the illegal surveillance. The undisputed documents show that AT&T installed a fiberoptic splitter at its facility at 611 Folsom Street in San Francisco that makes copies of all emails, web browsing, and other Internet traffic to and from AT&T customers, and provides those copies to the NSA. This copying includes both domestic and international Internet activities of AT&T customers. As one expert observed, “this isn’t a wiretap, it’s a country-tap.”

EFF is fighting these illegal activities on multiple fronts. In Hepting v. AT&T, EFF filed the first case against a telecom for violating its customers’ privacy. In addition, EFF is representing victims of the illegal surveillance program in Jewel v. NSA, a lawsuit filed in September 2008 against the government seeking to stop the warrantless wiretapping and hold the government officials behind the program accountable.

EFF is not alone in this fight. There are multiple cases challenging various parts of the illegal surveillance against both the telecoms and the government. This page collects information on EFF’s cases as well as cases brought by individuals, the American Civil Liberties Union of Northern California and of Illinois, the Center for Constitutional Rights, and others.
