UK Government Resurrects Plan To Monitor All Phone Calls And Emails

The British government has dusted off previously shelved plans to create huge databases, enabling spy agencies to monitor every phone call, email and text message as well as websites visited by everyone in the country.
The Telegraph reports that under the plans, the government will force every communications network to store the data for one year. The plans also extend to social networking sites such as Facebook and Twitter, and gaming sites.
The plans, drawn up by MI5, MI6 and GCHQ, the government’s secret eavesdropping agency, may be officially announced as soon as May, according to details seen by the Telegraph. Those agencies would have real time access to the records kept by companies such as Vodafone and British Telecom.
The records would allow the spy agencies to monitor the “who, when and where” of every phone call, text message and email sent, while also allowing for internet browsing histories to be matched to IP addresses.
Unassumingly titled the Communications Capabilities Development Programme (CCDP), the new scheme is set to be implemented under anti-terrorism laws, with the spy agencies saying it will allow them to more closely monitor suspects ahead of the London 2012 Olympics in July.
Critics and civil liberties advocates are calling for mass opposition to the plans, noting that the scheme is open to abuse not only by spy agencies and communications companies themselves, but also by hackers and online criminals.
Jim Killock, executive director of the Open Rights Group, a civil liberties campaign organisation, said: “This would be a systematic effort to spy on all of our digital communications.
“No state in history has been able to gather the level of information proposed – it’s a way of collecting everything about who we talk to just in case something turns up.” Killock added.

The U.S. government, with assistance from major telecommunications carriers including AT&T, has engaged in a massive program of illegal dragnet surveillance of domestic communications and communications records of millions of ordinary Americans since at least 2001.
News reports in December 2005 first revealed that the National Security Agency (NSA) has been intercepting Americans’ phone calls and Internet communications. Those news reports, plus a USA Today story in May 2006 and the statements of several members of Congress, revealed that the NSA is also receiving wholesale copies of their telephone and other communications records. All of these surveillance activities are in violation of the privacy safeguards established by Congress and the U.S. Constitution.
The evidence also shows that the government did not act alone. EFF has obtained whistleblower evidence [PDF] from former AT&T technician Mark Klein showing that AT&T is cooperating with the illegal surveillance. The undisputed documents show that AT&T installed a fiberoptic splitter at its facility at 611 Folsom Street in San Francisco that makes copies of all emails, web browsing, and other Internet traffic to and from AT&T customers, and provides those copies to the NSA. This copying includes both domestic and international Internet activities of AT&T customers. As one expert observed, “this isn’t a wiretap, it’s a country-tap.”
EFF is fighting these illegal activities on multiple fronts. In Hepting v. AT&T, EFF filed the first case against a telecom for violating its customers’ privacy. In addition, EFF is representing victims of the illegal surveillance program in Jewel v. NSA, a lawsuit filed in September 2008 against the government seeking to stop the warrantless wiretapping and hold the government officials behind the program accountable.
EFF is not alone in this fight. There are multiple cases challenging various parts of the illegal surveillance against both the telecoms and the government. Do you resent the government for enforcing Obamacare or raising your taxes? Write about it in an email or talk about it on the phone and you could be placed under surveillance as a potential terrorist, if frightening new technology being shopped to law enforcement agencies is implemented.
Forget pre-crime and get ready for face-crime, Big Brother is set to unleash a new wave of shockingly invasive and Orwellian technology on the American people if a recent symposium in Hamburg New York is anything to go by. Federal agencies, police departments and others were all in attendance to see a demonstration of a system that trawls phone conversations, emails and instant messages to detect “resentment toward government,” alerting authorities to potential “terrorists” who are then placed under surveillance.
The technology was demonstrated to law enforcement officials, mental health professionals, and military representatives at a recent International First Responder-Military Symposium held at Hilbert College.
“A Swiss professor working with a Massachusetts Institute of Technology scientist who heads the Mind Machine Project there outlined how this program operates through computerized scanning of phone calls and electronic messages sent through e-mail and social networking mechanisms,” reports the Buffalo News.
The system works by detecting “resentment in conversations through measurements in decibels and other voice biometrics,” more specifically the emotional spikes that characterize “hatred and deep resentment toward government.”
“As for written transmissions scrutinized by the computer program, it can detect the same patterns of fixation on specified subjects,” states the report.
Once an individual has been identified as harboring “resentment toward government,” the information can be “passed along to authorities so surveillance can begin.”
Besides law enforcement applications, the program is also designed to aid mental health professionals to help “war veterans” become emotionally stable, chillingly implying that distrust or hatred of government, which was hailed by the founding fathers as a vital virtue, is now considered a mental illness.
Of course, this technology completely violates the 4th amendment, but by introducing it as a tool to fight terrorism, authorities hope to skirt around the issue – the problem being that, as we have exhaustively documented, the federal government now sees any political activity whatsoever, be it anti-war protesters on the left, or anti-big government activists on the right, as potential domestic terrorists.
The technology is rationalized by its adherents, who claim that it will help stop terrorists in their tracks, while also being used against ‘troubled veterans and first responders’.
However, the introduction of a program that closely resembles George Orwell’s “facecrime” in 1984 has little to do with fighting extremist Muslims hiding in caves in central Asia, this is all about targeting the American people with total panopticon-style surveillance, while also creating a chilling atmosphere and reminding people that their every conversation, instant message or email is being scanned by super-computers for any sign of extremism or “resentment toward government”.
As we have seen from the MIAC report, the spying case in Pennsylvania, and a host of others in recent years, the federal government defines “terrorist propaganda” as any material critical of the state, therefore any dissent against Big Brother in a phone conversation or an email would automatically trigger the new technology.
This is not only a constitution killer, it represents a hammer blow to free speech. The Internet as a forum of open discourse and free exchange of ideas will be fundamentally damaged if people live in constant fear of being raided by the feds at any minute because they sounded off about the government in an e mail or a posting on a comment board.

Phone Companies to Keep Details of Every Phone Call For At Least One Year

Telecoms firms have accused the Government of acting like the East German Stasi over plans to force them to store the details of every phone call for at least a year.
Under the proposals, the details of every email sent and website visited will also be recorded to help the police and security services fight crime and terrorism.
But mobile phone companies have attacked the plans as a massive assault on privacy and warned it could be the first step towards a centralised ‘Big Brother’ database.
They have also told the Home Office that the scheme is deeply flawed.
The criticism of Britain’s growing ‘surveillance culture’ was made in a series of responses to an official consultation on the plans, which have been obtained by The Mail on Sunday.
T-Mobile said in its submission that it was a ‘particularly sensitive’ time as many people were commemorating the 20th anniversary of the protests that led to the collapse of ‘surveillance states in Eastern Europe’.
Martin Hopkins, head of data protection and disclosure, said: ‘It would be extremely ironic if we at T-Mobile (UK) Ltd had to acquire the surveillance functionality envisaged by the Consultation Document at the same time that our parent company, headquartered in Germany, was celebrating the 20th anniversary of the demise of the equivalent systems established by the Stasi in the federal states of the former East Germany.’
Equally trenchant was the response from Hutchinson 3G Uk Ltd, which read: ‘We take seriously the responsibility of safeguarding our customers’ information and data, and are unconvinced of the safeguards that the Government might make to protect against loss.’
The firm also said it had ‘substantial concerns’ over claims that public authorities would only be able to access data on a ‘case-by-case’ basis. It is understood hundreds of public bodies and quangos may also be able to obtain information from the system.
‘It is our belief the safeguards listed in this consultation are incomplete and do not extend far enough,’ it added.
Orange and Vodafone were also highly critical, with a spokesman for Orange saying: ‘The proposals are clearly not about “maintaining” capabilities but rather about “enhancing” existing capabilities.
‘Any debate should address what many will see as a worrying extension of the so-called “surveillance culture”.’
Since October 2007, telecoms companies have been obliged to keep records for a year. Under the new legislation, however, they will also be required to organise it better – for example, by grouping calls made by the same person.
Internet service providers have been required to hold records on emails and website visits since April.
Police and security services can already obtain such information if they are given permission by the courts.
The public will reimburse internet service providers and telecoms companies for the costs associated with storing the billions of records.
A Home Office spokesman said: ‘The police and security services need to be able to use communication data in the fight against crime and terrorism. Communications data forms an important element of prosecution evidence in 95 per cent of the serious crime cases.
‘Access to communications data under the Regulation of Investigatory Powers Act is subject to strict safeguards around how, when and by whom data is obtained.’
The activities of the Stasi, the former East Germany’s secret police, were memorably depicted in the Oscar-winning film The Lives Of Others, starring Ulrich Mühe. At the regime’s height, there were 200,000 agents and informers in a population of only 16million.
